    After having been following most of the EB3 related threads looks like EB3 folks are on their own. It would be great if we get any help from any quarter but I think it's fine even if we don't.We need to do something/everything that we can to generate noise apart from of course following all the IV campaigns .

    I looked at both the service center webpages(texas & nebraska) & I-485 application has to be sent to Nebraska only.I do not understand now why they are transferring the application from nebraska to Texas
    if I-140 is approved at Texas.
    Has anyone have any idea?

    can we add two polls within the date subcategories - one which tracks how many people received receipts, and another to check if they are NSC or TSC?

    Or are there other polls like this already for July 17 - Aug 17th I 485 Filers?

    Why don't you tell other proud americans to not

    1. admit us to your educational systems,

    2. give us jobs, and

    3. sponsor our green cards.

    Why don't posters on this forum move back to their home country and concentrate on making their home country great instead of slamming into someone else's country and just living off the wealth others have created?

    The bottom line is that a SKIL act is not needed. Hundreds of thousands of American programmers have lost their job to the third world, both in outsourcing and insourcing of third world programmers who work for cheaper wages. There is absolutely no need for more foreigners here and no need for more green cards. Temporary workers are just that - temporary. If you are on a temporary visa, work your time, make some money for your family and head home when your time is up. Don't cry that we don't provide enough green cards when you knew what kind of visa you were on.

    I applied April 18th and did FP July 22, 08.

    I was shocked to read your post and tears rolled on my cheeks. But I admire your determination to achieve your goal. Oh my God! You are a different kind of guy, Please don't lose your hope. I really don't know what kind of cancer and what stage are you at but I believe miralcles do happen. We all will pray for you. We wish you the best. I really want to say so many things but I don't know how.

    Last year we started a major membership campaign in Colorado. People kind of agreed that IV is the appropriate platform for this crusade, and they were willing to contribute money, but only if they see required transparency in the IV organization. Members of the state chapters have so far not heard about how the contributed money is spent, and what kind of lobbying took place in Washington.

    Is good to hear the cheers of "IV is our only hope", and yes in one way it is, but unless we bring required reform to IV, the status quo will maintain. That is several years since its inception : limited number of paying members, half hearted participation in various campaigns, and inactive state chapters.

    On the topic of “getting some of our measures during lame-duck session”, I am seeing some speculation (on other sites) that there is a chance these measures getting discussed during that session. I know these are just educated guesses, but it’s encouraging. see following:

    please read the numbersusa article below. We have do the same thing...inform all members when the Senators/House Representatives field hearing in their cities/towns and volunteers/members can organize to meet them and explain our problems to them.

    If it is possible we can show even documentary in the hearing which IV core team is preparing (if nt slideshow is also effective). Please come up with a strategy for this hearing......:)

    Hi guys,

    Did anyone here get this RFE (quoted below)? I have been working for the sponsoring company for the past 5+ years at various client locations. The current location is a different state from the employer state. I always had all LCA's etc..So any tips on how to respond is highly appreciated.

    Is just an EVL stating "same terms as in I-140 apply and still continue to offer" be good enough? Or do u guys suggest sending current LCA and pay stubs? I really dont want to send too much or too less..

    I know people have different things to say and my lawyer will have his own opinion, but i wanted to see if anyone got this and how their lawyers responded and what response got their approval. Thanks in advance

    GC Visa's are per country per year, where as H1's are not per country based, we indians used most H1's and stood in queue for GC's of course there is path so we stood, in fact it is one attraction they used to bring over here, to start with, per country GC visa limit is a poor thought.

    GC quota should be better tied to H1 quota or raise the limit and god knows when did they put the numbers per country GC, before H1b program or after H1b program.

    H1b program allowed hundred's of thousands to come in, in fact which they encouraged i can dare to say and GC visa count is not according to that and they let all these families to stay in limbo or wait forever is not a good sign.

    Irony is majority of these folks are purposed to solve or improve all kinds of problems ranging from improving enterprise's response time from months to minutes or minutes to secs and other kinds improvements, who's families and them selves stuck in a decade long "legal immigration" battle of their life.
    Hey, I like this suggestion a lot.

    Below is my post from one of the other threads and think might help the discussion here...

    I sincerely think that the reason why various immigration agencies are getting away with 'doing nothing' for Legal immigrants is because media does not discuss the backlogs in the immigration system. If we can focus on some really shocking statistics....data...and request some reasonable media personnel to discuss and take up as a story...it would be more helpful than all flower campaigns...and other forms of protests. I wrote to Fareed Zakaria today and you can do so as well. We can try other famous personalities on CNN such as Soledad O�Brien. If you know anybody on the Fox News side who might sympathize and investigate the issue, try them as well. Every media and politicians bracket us in the same group as illegals or fraud H1Bs...that image needs to change before something can happen...its absolutely bizarre and immoral in my opinion when the head of DHS cannot go to congress and say that there is an unfair situation for Legal Immigrants from India/China in the immigration system and she needs temporary assistance in fixing the system. Sec of State and Head of DHS surely have the authority to refer an unfair situation in the congress for a temporary legislative solution until the CIR is addressed.

    i know for a fact that 2 of my friends who were stuck in namecheck and had current PD got their GC approval emails 3-4 days after the rule was passed. I have EB3 PD of mid 2002 and was stuck in NC for 3+ years, i got a soft LUD one week after the rule was passed. it was the first LUD after 2 years.

    NC was hell and i hope people dont go through what we went.

    Yes, it would "improve" Name Check with coparision to what we have observed so far. But it still have following loop holes and flaws.

    Now I generally read and analyze. Do not just read.:)

    (1)180 days period is from the "Date of FBI Name Check initiation. It is not
    from 485 receipt date. Nobody knows when USCIS will initiate FBI Name
    Check. So I see a big playground for USCIS to play if it decides to play.
    What if uSCIS sends FBI name check initiation after 2 years of 485 receipt?
    Do we have a way to know or keep an eye on USCIS about this? At least I
    do not know and if somebody has the information please share it.

    (2) "If 485 Otherwise is processable" then USCIS can go ahead without
    waiting for NC check... What if USCIS decides to keep 100000 cases on
    rack eating dust just by not moving the processing date for particular
    service center? This you can see right now.. USCIS is making Texas slow
    day by day not moving processing date. I remember Texas was ahead
    with comparison to Nebraska around May to August 2007. If this happens your case is no more "processable".. Yes you can say that you are not stuck in NC queue but you will be stuck. USCIS may come up with altogether different startegy... To align processing times with FBI processing and FBI NC initiation. That may screw the things further.

    no receipt notice yet. Checks haven't been cashed as of this morning.

    i sent application for me and my wife on july 6th NSC my I 140 was applied in TSC . i am NJ resident. wife took info pass appointmnet as no check cashed, no notice receive. started worrying now. as NSC is updating even new applications no sure if my case was transferred to TSC or not . any body in same boat ? application was signed by R williams in NSC.

    Answer to question 1: Yes you can, but make sure that at least on paper the job responsibilities remain the same as the job for which your present employer sponsored your GC. The designation can be anything.

    Answer to question 2: USCIS is not very clear on the percentage increase/decrease in salary that a person should draw in a new job from the job which sponsored the GC. However, it says, that there should not be a huge disparity between the two. Looking at the figures that you provided, it looks like a huge disparity. I am pretty sure that the "bonus" in your first job was not accounted for in the salary which was mentioned in the LC by your sponsor. Even if they did, the difference seems to be huge. If it is possible, ask the BIG employer to offer you the same amount of 65K as salary and the rest as "bonus".

    1. Till now I worked on contract as a SAP Consultant with BIG 4 companies and piled up a lot of responsbilities. I got my EAD and one of the BIG wants me to join as Associate Partner- SAP. Can I accept it on EAD?

    2.Till now my salary is USD 65,000+Bonus.With bonus my salary is in the range of 120K -140K. But now the BIG 5 offers me a salary in the range of USD 180K -200K.
    Can I accept the 'offer' based on the above points and use my EAD?
    Or is it a violation of AOS rules?
    Appreciate if you throw light on this specific case

    Thanks unitednations.

    unitednations was sharing valuable insight about the H1B denial trend in the begning. Then, every one started dragging him in to useless discussions with all kind of arguments.

    How does it matter now?. Whether the mess was caused by desi companies alone or with the help of some guys who got H1 for their wife , brother, mother and the local policeman who learned SAP in a week, the damage is already done.
