My situation is not any better. I am working for a GA based company since 2001 got stuck in the backlog center with Priority Date Oct 2003 (labor apporved in Nov 2006 I-140 applied in May). After calling the company HR for 30-40 times in last one week I was able to talk to HR guy, he said the ceo will allow only those who have approved I-140 to apply for I-485. He also said then once priority date retogressed again I will be able to get 3 years H1B ext. that will be good for me.:mad: I think these desi blood sucking compnies will be obsolete in couple of years. If USCIS make the rules better.

I was thinking of disclosing my employers name but then I will never be able to file I-485

Its a universal truth that Desi companies are blood suckers still we will work with them .....who to blame ???????

That observation on the SKULL bill and masters degrees was raised by few concious and noble members of this forum before.

Do you realize that in certain schools I know very well here, they don't even require you to take TOEFL or GRE/GMAT for grad school. Believe me, there are thousands of people in the world with $20K who would line up for such "graduate" schools and move here permanently. I am saying, any lobbying effort should be directed to tone down such bills, they are simply not very realistic at this point.

If skill bill is passed in the same form as it is Americans will be alarmed seeing the inflow based on exemption of US based Master degree and STEM. Not only to Americans it is threat for current H1s and green card holders as well. The problem is those who have money in India can get admission in USA MS degree in any non standard college(I do not think INS can evaluate whether it is standard or not). So atleast 4 times of current MS students will come and they will get h1(I think Ms people has exemption in quota) thro Desi consultants by paying Money and get green card immeditely. This will defeat the purpose of skill bill itself. And also India so many people are doing MSC they can get gc easily here(As we know Indians or anyone will use loopholes to come here and get gc). If immigration is increased so much then it will impact all kinds of exsisting people. I think there should be control in number of h1s and also green cards. I am clear that both H1 and green card numbers should be increased but blanket exemption should not be given any category especially for H1. There were a situation on 2000 and 2001 lot of people returned India because of too much supply and Americans were angry with immigrants at that time especially H1 because they were laid off.

So basically increase of immigration should be based on supply and demand . The purpose of Labour certification is to verify whether any american is rejected for that job. But that is now just formal and real test is not done(it is not possible to do it. If they do it it will take years to clear). I think if they double number of gcs the retrogession issue will be resolved for atleast another 5 years

I hear ya and feel for you Nag. That is why I posted a thread inquiring about ability to file for AOS/benefits after I-140 even when PD is not current. I believe this is an achievable administrative fix, however with almost everyone applying in July/Aug, this may be on the back burner in the foreseeable future.

I am not sure about that. Most of the EB3 guys have advance degrees (including me) but not necessarily with US degrees.

I would not agree that most folks in EB3 have advanced degrees. Most do not. They have lot of experience though


believe me...you would think that people with advanced degrees would have applied in EB2...but there are cases where people have had to apply in EB3 category even with an advanced degree


I disagree with this too. Here are a few examples
1) A couple of years ago, when there was no retrogression, most folks did not want to take a chance and thought EB3 was a safer bet
2) Many Advanced Degree holders from US Univs joined a firm and their GC was applied immediately. But since they did not have enough work ex, they applied in EB3
3) Lots of scrupulous employers heard about retrogression and were actually very happy. They purposely filed even highly qualified folks as EB3 so that their abuse can be prolonged
4) Incompetent lawyers who felt they would not be able to prove the necessity of EB2
5) Sheer ignorance on the part of the beneficiary

How about we come up with a skit where we can reenact the drama about the whole episode in a funny way. Where we can have people portraying roles of USCIS Director, Secrtary of State, Immigrants calling franctically to India to get their documents, parents running around to get doucments, the start of rumor, the employees of uscis working on sunday to adjudicate the cases, then the flip flop of DOS. etc. Then we can put this on youtube and will attract publicity.

I respectfully disagree. It has nothing to do with marketing, fraud desi companies put up free ads on sulekha, its the mindset of a large number of our audience we are missing and need to account for. maybe it has to do with jugaad.
Of course many of these expectations cannot be satisfied in a honest non profit.

A dinner for a family costs $50 easily.
A movie for a family costs $50.

The mindset is incepted deep inside and it is extremely difficult to change.

Sometimes, I see people wanting to do something, but their spouses don't allow them to.

When I told people that I received GC - some desis who r still waiting got pissed. I heard all sorts of things, some say "You cheated", some say "Never knew you were Eb2", some say, "Are you sure?, have you got the cards yet?, Did you finish biometrics?" Some eb3 folks said "We will get ours too, some issue with finger prints , my husband's boss is very close to the congressman and we have influence in INS", some say "Your lawyer did some magic" etc.....

People carry such mindsets, it is difficult to bring about awareness and change.

if you see life as a series of choices and actions, then the lack of GC inhibits a lot of choices and actions.

how badly you wish to change career for example, varies among individuals. but one should not forget that life is finite number of years, and the system here wants to eat all your productive years by dangling the GC carrot.

as sufferers of this ordeal, i believe it is our duty to inform the young and innocent who are not yet in this mess, about the future that awaits them.

mind you i am not discouraging anyone from coming to the US.. that is a decision that must be made by the individual.... just making sure the rules and realities of the game are known to people before they come here.

For I-485, took help from local congressman's office in 2007 for name check clearing and security check clearing. They also helped me last month for getting the FP appointment letter for expired FP.

Sending a grammatically incorrect letter is much better than sending no letter or sending one in Jun-10. From last 2 days, I saw no one doing anything. Hence I sent my letter. Correct, I didn't spend too much time on it. If you so care for grammar when are you getting the correct letter out?

I have only seen one person get through background check in the last year. That was through senator intervention. Person got approved (it was a premium processing case). companies generally do not want to go throgh senator/congressmen intervention due to fear of tweaking uscis.

Since his 140 is approved then he is not subject to the quota. However; he could just wait or file another h-1b with another comany. If he asks for I-94 card then uscis could ask for maintaining status. He is in what is considered a "bridge period". that is when I-94 card expires; you are legally here but if you fle an h-1b with another company then they shouldn't approve the second h-1b until the first one is approved (uscis doesn't always do this). Sometimes they approve the second one. However; if the first one gets denied then you wuld not be considered in "status" from date I-94 card expired until second companies h-1b got approved with I-94 card (would have greencard implications later).

He could just file an h-1b with another company in premium (do not ask for I-94 card). If/when uscis approves it then he would have to go for visa stamping and get I-94 card at the border.

If you have any emergency to go out of country or to change jobs, you can get your passport stamped by taking an Infopass appointment or you can request IO to upload the Biometrics to TSC. you will get the card in 10 or 15 business days after uploading the biometrics. either way your GC is approved..so no worries.

My answer is depending on my experience with GC.

That is probably the most absurd thing said in this forum.

Purgan, please do some basic research and you will see you are plain wrong. There is no way you will see your dream coming true. Govenment intervention when it comes to regulate the influx of foreign labor is everywhere. It is controlled. You just allow less or more people coming in and that is fair. If you allow the gates of a third world country to open for good and flood this with programmers to a point where you would be making $10/hour, nobody sane wants to get downgraded to that level. Foreigners with a funny accent like us would be competing for jobs. Probably employers would love and exploited people in the third world countries would love that, but I have to tell you things don't work that way.

Similar polls were conducted by Zogby, CNN, etc. I outlined other evidences there. Only individuals with an open mind can read between the lines though.


when american's from such third rate schools are not getting jobs, do you seriously think foreigners with their funny accents and relatively poor English communication skills (I'm Indian and can tell you its still a second language to me) can get jobs??

The market has a way of regulating itself. As someone mentioned above, there were a a lot of H1 space available from 2001-03. But it never got filled because there were simply not enough jobs. Lets not try to set up govenment intervention here....let the free market decide....that is what made this country great.

btw, NumbersuSA, FAIR and other restrictionist organizations have zero credibility because they oppose even legal immigration.

I don't think having a MS degree supercedes a BS always.
How can you compare say for example a BS+10 yrs person with a kid just out of school doing MS. Doesn't jive. I think at somepoint both level off. Just merely having a MS degree doesn't mean anything without experience.

IT is not just one such field. You would find other's too. Financial aspect that you are talking is a whole different topic

You are right in your observation. But, the SKIL Bill seems to place emphasis on people with advanced degrees. So, whether you and I agree about the Bachelors + work experience part or not, the fact of the matter is that the Bill exempts people with advanced degrees from cap limits.

i sent application for me and my wife on july 6th NSC my I 140 was applied in TSC . i am NJ resident. wife took info pass appointmnet as no check cashed, no notice receive. started worrying now. as NSC is updating even new applications no sure if my case was transferred to TSC or not . any body in same boat ? application was signed by R williams in NSC.

You will see a date on I-485 only if you filed I-140 & I-485 concurrently. Even my I-485 does not have any priority date.

Do you have Pritority Date written on your I-485's notice of action? It's blank for me.

Working on EAD for a short time, even in a different occupation, with 1099 is not an issue. However, this will not satisfy the requirement for 485 approval. You must have a valid fulltime, permanant job offer in the same or related occupation at the time of 485 approval as well as when they issue a RFE regarding your employment.

Let us first complete July 10th mission flower campaign, where many people here including me has sent flowers for july 10th delivery.
Let us see its impact by July 11th and then try another round by sending flowers to local senators and congressmen with simple message of costs involved and lost money and oppurtunity by revised july bulletin.

Also, unless we make explicit mention of costs involved, i think impact wouldnot be felt.

Only if it is too restrictive. this case is pretty straightforward and simple. employee is directly hitting the employer's revenues.

I am not hitting on employers revenues, infact employer made money since two yrs because of me. The reason is, employer never got this project for me. It never had any business either with PF or with the client earlier. It was only because of my contact with the PF i got the project. i introduced the PF to my employer, have them sign a contract and since these two yrs my employer was able to place 4-5 consultants through the PF i introduced to them. Now tell me, how much my employer would have made because of me or other consultants??? Even after all this, he is being mean to me. these desi companies thirst for money is never ending. whereas consulatnts can never look up for a better life!!!!!!

I have already used AP to enter US after my last trip to India. So IO at POE canada will know that I have pending 485. don't know how to handle this situation.

I am planning to do the landing in last week of may via Niagra falls. (toronto)

Yup, kshitijnt you are right on target, we need to do some thing constructive and let our voices heard.

BECSufferer made it right heading...channel your anger.

My intention was more to think in right way and discourage potential -ve result bound strategies.

During presidential campaign there were all over promises on clearing backlogs, we can go on that basis and make a point of that.

One thing is clear if they like to stop outsourcing sure they have to encourage and stream line legal immigration they cannot stop or survive but cutting outsourcing as well leaving this legal immigration in limbo.

Besides what we can do at this juncture, keep our voices heard by contacting, writing letters.

1. In a world leading country processing a decade back applications is not an encouraging trend to legal immigration, this may send a wrong signal to legal immigration over illegal immigration.

2. Can highlight ecomonic point based on these math...
Ex: 500,000 EB backlog persons contribution to the country, social taxes = xxx, medicare = xxx, travel=xxx, housing =xxx.
